ok so here in Fredericton people are beginning to complain about noise level's of vehicle's exhaust, and this was in the paper today

Muscle car owners and bikers beware, Fredericton police are giving city cruisers six weeks to muffle their engines or face a $168 fine.

Police say they are receiving far too many complaints about loud and unnecessary noises emanating from motorcycles and souped-up cars in New Brunswick's normally quiet capital.

Fredericton resident Judith MacFadzen is one of the complainers. She says it's getting to the point where she can't walk downtown or sit at an outdoor café without being startled by a noisy motorcycle or car.

Her frustration boiled over this spring, as an increasing number of cars with deafening engines rumbled past her house, ruining her train of thought.

"If it's a broken muffler and they have to get it fixed, you can understand that. But some of them you know, it's just for the, the sheer pleasure of [making noise] that's not pleasant," she said.

Fredericton police Cst. Andrew Miller says a section of the Motor Vehicle Act prohibits excessive or unusual car exhaust noise.

He says officers will warn noisy drivers for the next six weeks, but after that, the ticket books will come out. He says there is no set decibel level motorists will need to obey.

"You have to go by what's excessive. What our officers are being explained to do is just go sit somewhere for five minutes. And as you sit there, you'll hear one of those cars come screaming by," Miller said.
now i don't understand how they are going to enforce this because this is the section of the morot vehicle act here in NB that the officer is talking

235(1) The driver of a motor vehicle that is being operated on a highway shall ensure that the motor vehicle is equipped with a muffler and exhaust pipe or pipes in good working order and in constant operation so as to prevent excessive or unusual noise, and no person shall operate a motor vehicle equipped with a muffler cut-out, by-pass or similar device.
now this has got to be the most vague thing i have ever seen "excessive or unusual noise".. they don't even have a set dB limit, i mean comeon...$168 fine for somwething someone else think is "loud"?.... if i had an aftermarket exhaust on my car i would deffinately fight it... and i know i would win cause of the motor vehicle acts vagueness

well that is my rant for today....

Since the law is so vague, maybe you(or some1 else) can fight it in court.

oh c'mon thats utter bull****. in cali the noise level can't pass like 92db or something.

they can't be that vague, you know when its put like that, the cops wont inforce it. they're just trying to scare you. if they wanted to be serious about it they would be getting ideas from the cali laws.

yeah that's not cool at all....in the states they have that sema action thing to fight laws that anr unfair to the tuning scene...maybe some ppl should get together and see if we can form one here in canada

The law is vague so it can be selectively enforced. This gives them a valid excuse to pull you over and make sure your on the up and up. You can fight it if they give you a ticket but you most likely will loose as tickets are a source of revenue for the city and since the law is vague the judge will rely on the officer's judgement. Sorry.

lol this makes me cringe because i just finished my state and local politics class

it is not right that the city is not putting a dB level so there is not an accurate measure of what is loud and what isnt. it does seem like bs, but i guess you gotta live with it. dont re elect the office holders now....

oh come guys stop fooling yourselves. You know exactly what a loud and unusual exhaust is. Motorcycles are freaking worse. I was sitting outside a cafe with my girl the other day chilling, and a 2 hogs pull up to the stop sign, and roar off, loud enough that someone like me who listens to 150db system for jollies cringed. Same goes for after market "fart cannons" and straight pipes on trucks. There is a definate differance between a nice subtle tone of a stock exhaust, and the loud obnoxious tone of an aftermarket(not all mainly the cheap autozone ones, I know a good aftermarket magnaflow/flowmaster exhaust has a sweet tone).

db meters are pointless as are the rules that guide them. for noise ordinances for systems its 100db from 50 feet, I can talk that loud. And cops aren't carrying around meters.

They left the law open, not vague. They know exactly what they are going after, and anyone who is worried about this law knows why they are coming after them. Silencer plug > *

I got this last year and it ended up costin me $257.50.I ended up payin over $2,000 for racing.

Thats so stupid, alot of bikes come out of the factory with a loud exhaust. How are you supposed to fix that, buy a whole new exhaust for your brand new bike, thats bull. In my area its kinda enforced. Ive been pulled over in my Tempo (exhaust was ripped off), my 300ZX, and my civic and all i got were warnings. Still not going to change my exhaust for some pigs.
