Sucks that the old dude wasn't charged. There are ppl who are 70+ out there who are still pretty good drivers. Sad to say that a majority of the 70+ crowd are NOT good drivers.

why would you talk to YOUR INSURANCE if he hit you? you file the claim with HIS INSURANCE.....
if your insurance pays for your damaged car then your rates can go up!

Here is where it gets confusing. The old man was at fault, MTO calls it 'Following to Close' or something. Ontario is different,my insurance co.fixes my car free of charge (I don't pay a deductible because it wasn't my fault), when the claim goes through his will definately go up. There is a chance mine may go up, at most 3% per year for 3 years, which is 115$ total. The girl at the office said that because we have the same insurance co she would swing more towards me not being affected. My file/history won't have an accident, just that I was hit. If that makes any sense to any one here you are way ahead of me, for all I'm concerned no one on my side should pay a dime, but that is the way no - fault insurance works. The old man is going to be pissed though he figured his insurance would only go up like 10$ per year but the girl checked and it will be 260 for 6 months he is probably going to call me and harass me. Maybe he'll take it to the next level.....
