Not true. Its called Circumstancual Evidence.
Ex. You go to sleep at nite, when you wake up the next day there is snow on the ground. You didnt see it happen, but you know it did.
Granted this situation is much much different, but that type of damage is not conducted by a neutral party. Take it to court with a lawyer who knows his stuff, you wont leave completly empty handed.

In other words, the owner could be mistaken, and say that he knows pcupo12 did the damage, but do you think they'll charge you? No, they can't charge you, but they'll ask you questions hoping that you'll screw up and give them some evidence. In other words, if you keep denying it and say nothing else, they can't prove sh*t.

Well Sort of. You see, the fact that there is circumatantual evidence gives the po-po the probably cause they need to do an in-depth investigation. They will want to know where the suspect was when the criminal mischief happend, who he was with and how he can prove he was there. Theyll get em.

The police can go as far as requiring documented evidence of his whereabouts during the time of the crime. This isnt the sort of crime that would be taken lightly. Judging by the sound of the dude, im SURE hes got a nice wrap sheet, which wont help him either. The cops will be able to crack it.

All it would take is one spot of paint on the guy, or the guys car to prove his guilt. But the looks of it, i would say that he probably got a little on himself during this little endeavor.
