Default Ebay is brainless...

As some of you know, I've had problems with scammers using pictures ofmy car on Ebay. Ebay has successfully resolved 4 cases prior to now. The fifith most recent one was unsucessful. I reported it the same way with links to my cardomain site, my HCF gallery and even my photobucket link. Plus, I even clicked on "live help" and chatted with two ebay reps with additional links to my pics going over the status of the investigation. Anyway, here's what they wroteme tonight...

Dear Joseph,

Thank you for writing eBay in regard to the unauthorized use of your
text or images by another eBay user.

We have reviewed your listing and the listing that you reported, listing
#300150165421. We are unable to take action due to the following
reasons:

•The reported text appears to be text that is used by the manufacturer,
and/or is widely available on the web.

We haven't found a violation of eBay's Item Description and Picture
Theft policy.

If you still feel that these listings are substantially similar and do
violate eBay policy, please respond to this email with specific examples
demonstrating that this seller is using your material without your
permission.

If you haven't already contacted the seller that you are reporting, we
encourage you to do so before responding to this email. We have found
that many people are unaware that using images or text that they have
found on eBay or other sites on the Internet is a violation of eBay
policy. Many of them will change their listings when contacted by the
owner of the material.

For more information on this subject, please visit the link below:

It is my pleasure to assist you. Thank you for choosing eBay.

Sincerely,
Bronwynn

WOW... Here is my response to them...

This is ridiculous. You stated pictures/description of my car are used “widely on the web” or “used by the manufacturer.” So are sellers allowed to represent their auctions with misleading descriptions and pictures? I would surely hope not. It’s clear the seller is falsely representing an auction with pictures of my car intending to deceive potential buyers into thinking the winning bid will result in ownership of my car (pictured in the auction). Mind you, this is the 5th time this has happened and I can guarantee you IT WILL HAPPEN AGAIN. The first 4 times it happened, Ebay removed the item from listing with the exact same information supplied by me. How is it that a different conclusion is attained with the same exact evidence and scenario? If Ebay cannot resolve simple cases of fraudulent activity, what is the use of me wasting my time reporting them? This is indeed a mockery ofthe trading experience using Ebay online services. You are promoting fraudulent activity by proving yourself unable to identify and resolve it. Iam sorely disappointed in the resourcesof Ebay investigative staff. I can guarantee you if funds were transacted on item #300150165421, you will be receivinga seriouscomplaint from the winning bidder.

It's happened a few other times that I haven't brought it to HCF's attention. This makes a total of 5 times with Ebay...Plus it was posted on Craiglist at one time. They pulled it down within a few hours.

Flip, from what I understand, I don't think Ebay got this one straightened out.I know the guy had a reservebut I don't know if it was met or not. Ebay won't give me the final outcome of the sale.
