i went with the smoked one, not the black out.
it looks much darker because of the color of my car.
under bright sunlight it doesn't look all that bad.
I actually was disappointed when I first put it on.
I would be safe and go with the 38 % one just so others can see your signals and brakes.
And yes, tinted tails is basically just asking to get pulled over... but at least you can remove them easily with the film.
