No, since the government provided the number, the car company is immune if the government's result was wrong.
Speeds below 85 mph would give better mileage. This is unavoidable physics since air resistance (the dominant enengy demand of a car moving at highway speed) increases exponentially with higher speed. Also not having the gas tank full makes the car lighter, which increases mileage.
